This proposed subdivision had been previously reviewed and denied by the Planning Commission on February 12, 2004 (2-SD-04-F). Staff had recommended approval, however, based on claims by adjoining property owners that the covenants would not allow the subdivision, the Planning Commission had voted to deny the plat to allow time for this issue to be addressed. The property owner has resubmitted the plat for consideration by the Planning Commission. Both parties have hired Counsel to represent them at the meeting.
